These Terms of Service ("Terms") govern your access to and use of Underwriter, an AI-powered website builder platform ("Underwriter," "we," "us," or "our"), including our website, platform, AI services, and related applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using Underwriter, you agree to:
- Be bound by these Terms and our Privacy Policy
- Comply with all applicable laws and regulations
- Be at least 13 years of age (16 in the EU)
- Not use the service for any unlawful purpose
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- One account per person — you may not create multiple accounts.
3. Services and Credits
3.1 Credit System
- Credits are used to access AI features including website generation and AI chat.
- Credits are non-refundable once consumed.
- Credits do not expire.
- We reserve the right to adjust credit pricing with reasonable notice.
3.2 Payments
- All payments are processed through Stripe.
- All charges are in USD.
- We do not store your payment card information.
- Refunds are handled on a case-by-case basis — contact support@underwriter.dev.
4. Acceptable Use
You agree NOT to:
- Use the service for any illegal or unauthorized purpose
- Generate or distribute harmful, abusive, or offensive content
- Attempt to reverse engineer, hack, or disrupt our services
- Violate any intellectual property rights
- Use automated tools to scrape or abuse our services
- Share your account credentials with others
4.1 Law Enforcement Cooperation
We take unlawful activity seriously and cooperate fully with law enforcement authorities. If your account is found to be involved in any illegal activity — including but not limited to fraud, harassment, distribution of illegal content, or any violation of applicable law — we reserve the right to immediately suspend your account and disclose all relevant account information, usage data, IP addresses, and communications to the appropriate authorities upon request or as required by law. By using Underwriter, you acknowledge that illegal use of our platform carries real legal consequences.
5. Intellectual Property
5.1 Your Content
You retain ownership of all content you create using our platform. By using our services, you grant us a limited license to process your content to provide the services.
5.2 Our Platform
The Underwriter platform, including its code, design, and branding, is our intellectual property. You may not copy, modify, or distribute it without permission.
5.3 AI-Generated Content
AI-generated code and content are provided "as is." You are responsible for reviewing and validating all AI output before use in production.
6. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Disclaimers
- Our services are provided "as is" without warranty of any kind.
- We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
- We are not responsible for any data loss resulting from service interruptions.
- We do not warrant that our services will be uninterrupted or error-free.
8. Limitation of Liability
To the maximum extent permitted by law, Underwriter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services.
9. Termination
- You may terminate your account at any time by contacting us.
- We reserve the right to suspend or terminate accounts that violate these Terms.
- Upon termination, your access to the platform will cease. Unused credits are non-refundable.
10. Governing Law
These Terms are governed by applicable law. Any disputes will be resolved through binding arbitration or in the appropriate courts.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of our services after changes constitute acceptance.
